These SMS Terms of Service ("SMS Terms") govern your receipt of text messages from the RacquetWorks platform operated by Cliff Drysdale Management, LLC ("CDM," "we," "us," or "our"). These SMS Terms supplement the RacquetWorks Access Agreement and the CDM Privacy Policy, available at https://www.racquetworks.co/privacy-policy. By opting in to receive text messages from RacquetWorks, you agree to these SMS Terms.

1. Consent and Enrollment

By providing your mobile telephone number and affirmatively opting in through the RacquetWorks platform, you consent to receive recurring automated text messages (SMS and MMS) from CDM at the mobile number you provide. Your consent is not a condition of purchasing any goods or services or accessing the RacquetWorks platform. You represent that you are the account holder for the mobile number provided or that you have the account holder's authorization to enroll that number.

2. Types of Messages

Messages may include, but are not limited to: educational and coaching content, lesson and program reminders, scheduling notifications, industry updates, platform announcements, event notifications, professional development tips, and promotional or marketing communications related to RacquetWorks, CDM services, and affiliated programs.

3. Message Frequency

Message frequency varies based on your activity, preferences, and platform updates. You may receive approximately 2 to 8 messages per month, though frequency may increase during periods of heightened activity, such as conferences, special programming, or new content launches.

4. Message and Data Rates

Standard message and data rates may apply to messages sent and received, depending on your mobile carrier and wireless plan. CDM is not responsible for any charges imposed by your carrier.

5. Opt-Out

You may opt out of receiving text messages at any time by replying STOP (or QUIT, END, CANCEL, or UNSUBSCRIBE) to any message. You may also opt out by emailing privacy@cliffdrysdale.com, by calling 830-625-5911, or by any other reasonable method of communicating your preference to discontinue receiving messages. Upon receipt of your opt-out request, we will send a single confirmation message confirming your unsubscription. No additional text messages will be sent to your number following your opt-out, except as required by law. Your opt-out will be processed within 10 business days, though we endeavor to process all requests immediately upon receipt. Opting out of text messages will not affect your access to the RacquetWorks platform or any other services.

7. Supported Carriers

Messages are supported on major U.S. carriers, including AT&T, Verizon, T-Mobile, and others. CDM does not guarantee message delivery on all carriers or devices.

8. Privacy

Your mobile number and opt-in information will not be sold, rented, or shared with third parties for their independent marketing purposes. We may share your information with service providers who assist in delivering messages on our behalf, subject to confidentiality obligations. Our collection, use, and processing of your personal information, including your mobile number, is governed by the CDM Privacy Policy, available at https://www.racquetworks.co/privacy-policy.

9. Disclaimer of Warranties

Text messages are provided on an "as is" and "as available" basis. CDM makes no warranties, express or implied, regarding the availability, timeliness, or accuracy of text messages, including warranties of merchantability or fitness for a particular purpose. CDM is not liable for any delays or failures in message delivery attributable to carrier networks, device compatibility, or other factors beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by applicable law, CDM, its affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or related to your receipt of, or inability to receive, text messages under these SMS Terms.

11. Modifications

CDM reserves the right to modify these SMS Terms at any time. Material changes will be communicated via the RacquetWorks platform or by text message. Your continued receipt of messages after such notice constitutes acceptance of the modified terms. If you do not agree to any modification, you may opt out at any time as described in Section 5.

12. Governing Law

These SMS Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of laws principles, consistent with the governing law provision of the RacquetWorks Access Agreement.
